These Terms & Conditions (“Terms”) govern the use of Postscripty’s services and website. By accessing our website, placing an order, or using our services, you agree to be bound by these Terms, our Shipping & Ordering Policy, Privacy Policy, Return Policy, and Cookies Policy, all of which are incorporated herein by reference.

By placing an order, you acknowledge that you have read, understood, and agree to these Terms & Conditions, including the Refund & Cancellation Policy.

1. General Terms
1.1 Acceptance of Terms: By using the Postscripty website, creating an account, requesting a free sample, or purchasing our handwritten direct mail services, you agree to these Terms and Conditions and any policies referenced herein, including our Privacy, Cookie, and Refund Policies.

1.2 Eligibility: You must be at least 18 years old to use this website or order our services. By using our services, you confirm that you meet this requirement.

2. Services
2.1 Handwritten Direct Mail Services: Postscripty creates, prints, and mails handwritten cards and related direct mail campaigns on your behalf, using the recipient list and design choices you provide upon purchase and with your intake form. These services are subject to the specific details outlined in your order.

2.2 Free Samples: We may offer free samples of our products. Requests for free samples must comply with the terms outlined in our Privacy Policy. We allow one per customer.

2.3 Results: We do not guarantee specific business results, sales, or client responses from use of our services.​​​​​

3. Payment & Billing
3.1 Payment Terms: Payment is required at the time of placing your order. All orders must be paid in full before production begins.
3.2 Subscriptions: By purchasing a subscription, you authorize Postscripty to charge your payment method at the agreed billing frequency until canceled in accordance with these Terms. You may cancel the subscription at any time; cancellations will apply to the next billing cycle.

3.3 Payment Processing: We accept most major credit cards, debit cards, and PayPal. We use third-party payment processors to handle all transactions securely. By submitting your payment information, you authorize Postscripty and our payment processor to charge your card or other payment method for the agreed amount, both for the initial cost and subsequent subscription costs.

3.4 Card on File: Postscripty reserves the right to store your payment information, and all transactions are handled using encryption and industry-standard security protocols. We store credit card information on file for orders and subscriptions. This allows us to update your quantity based on the number of clients' names and addresses you upload or update. You may see multiple payments go through if you update or change your quantity or subscription.

3.5 Declined Payments: You agree to provide accurate, current, and complete payment information when placing an order. If a payment is declined or fails, your campaign will be paused until payment is successfully processed.
3.6 Errors: If you believe a payment has been made in error, contact us immediately here.

3.7 Price Changes: We may adjust prices with at least 30 days’ notice for subscription customers.

4. Refunds and Cancellations
​
Because of the custom nature of our work, all sales are final once printing begins.
​
4.1 Cancellations: You may cancel your order any time before printing starts. Once your proof is approved - either explicitly by you or automatically 72 hours after it is sent - printing begins, and cancellations are no longer possible. Cancellation requests must be emailed to dylan@postscripty.com and are only valid upon written confirmation from our team.

4.2 Refunds: No refunds are provided once printing begins or mail has been sent. No refunds are given for USPS or other shipping partners' (UPS, FedEx, etc.) delays, loss, or misdelivery. No refunds are given for errors in recipient names, addresses, or details provided by you.
4.3 Errors: If an error is due to our mistake (e.g., incorrect printing from the approved proof), we will reprint and resend at no cost. If the error is due to incorrect information you provided, we do not offer refunds or changes.

5. Client Responsibilities
​
5.1 Accurate Data: You are responsible for providing accurate and complete mailing lists. Any misspelled names or addresses on the intake form are your responsibility, not Postscripty's. If we notice discrepancies, we will contact you, but we do not offer full client list reviews or accept responsibility for mistakes.
5. 2 Proof Review: You must carefully review and approve all proofs before printing. Your proof will be automatically approved 72 hours after emailing.
5.3 Compliance: You are responsible for ensuring that your campaign content complies with applicable laws, including fair housing, anti-discrimination, and marketing regulations.​

6. User Accounts
6.1 Account Creation: To place an order, you may need to create an account. You are responsible for maintaining the confidentiality of your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.

6.2 Account Termination: We reserve the right to terminate your account or restrict your access to the website at our discretion, for reasons including but not limited to violation of these Terms and Conditions, suspected fraudulent activity, or failure to comply with applicable laws.​​

7. Intellectual Property
7.1 Ownership: All content on the Postscripty website, including but not limited to text, graphics, logos, images, card designs, handwriting styles, and software, is the property of Postscripty or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
7.2 Use of Materials: Any unauthorized use of Postscripty's materials may result in the termination of your right to use the website. Legal action will be taken in appropriate cases.
7.3 Your Content: You retain ownership of all content you provide but grant Postscripty a non-exclusive license to use it to fulfill your order.

8. Limitation of Liability
8.1 No Warranty: While we strive to provide high-quality services, Postscripty provides the website and services "as is" and makes no warranties, either express or implied, regarding the accuracy, reliability, or availability of the website or services. We do not guarantee that the website or services will be uninterrupted or error-free.
8.2 Limitation of Liability: To the fullest extent permitted by law, Postscripty shall not be liable for any damages arising from your use of the website or services, including but not limited to direct, indirect, incidental, punitive, or consequential damages, even if we have been advised of the possibility of such damages. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or business opportunities. Postscripty’s total liability for any claim shall not exceed the amount paid for the specific order in dispute.

8.3 Disclaimer: Any free samples provided by Postscripty are offered "as is" with no guarantee of their suitability for any particular purpose. We are not responsible for any delays, errors, or damages related to the mailing or receipt of orders or free samples.

9.4 Disputes: All refund and cancellation disputes are governed by the Refund & Cancellation Policy.

9. Shipping and Delivery
9.1 Domestic Shipping: All orders are processed and shipped within the timeframes specified on our website. Delivery timelines are estimates only and not guaranteed. We are not responsible for any delays caused by postal services or other shipping carriers.

9.2 Loss or Damage: We are not responsible for loss, damage, or delay once mail has been accepted by USPS or other carriers.

9.3 International Shipping: Postscripty does not currently offer international shipping. All orders must be sent to addresses within the United States. If you upload international addresses, we will flag them, alert you, and not send to these clients.

10. Force Majeure
We are not responsible for delays or failures to perform caused by events beyond our control, including natural disasters, postal strikes, labor disputes, or supply shortages.

11. Modifications to the Terms and Services
11.1 Changes to Terms: We may update these Terms and Conditions from time to time. Any changes will be posted on this page with the new effective date. By continuing to use the website and services after changes are made, you agree to be bound by the revised terms.

11.2 Changes to Services: Postscripty reserves the right to modify, suspend, or discontinue any part of the services, at any time, with or without notice.

12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles. Any disputes, legal action, or proceedings will be resolved through binding arbitration in Chatham County, Georgia, except that either party may seek injunctive relief in court. You agree not to join any claim with others in a class action.
